Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Volera mobile application ("App") operated by Volera ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

  • You are at least 13 years of age (or 16 in the European Economic Area).
  • You have the legal capacity to enter into these Terms.
  • You will comply with these Terms and all applicable local, state, national, and international laws and regulations.

2. Description of Service

Volera is a wellness and supplement adherence application that provides:

  • Supplement Tracking: Tools to log and track your daily supplement intake.
  • Daily Check-ins: Wellness check-in questionnaires to monitor your health progress.
  • AI Wellness Advisor ("Vera"): An AI-powered chat assistant that provides general wellness guidance and supplement timing recommendations.
  • Streaks & Progress: Gamification features including streaks, daily scores, and progress tracking.
  • Widgets: Lock screen and home screen widgets for daily reminders.
  • Push Notifications: Customizable supplement reminders and motivational notifications.

3. Important Health Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

  • Vera, our AI wellness advisor, is powered by artificial intelligence and provides general wellness information only. Vera is not a doctor, pharmacist, nutritionist, or healthcare provider.
  • The information provided by the App, including supplement timing suggestions, wellness insights, and check-in analysis, is for informational and educational purposes only.
  • Do not use the App as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or supplement regimen.
  • Do not start, stop, or change any supplement or medication based solely on information provided by the App.
  • If you experience any adverse health effects, discontinue use and consult a healthcare professional immediately.
  • We make no representations or warranties regarding the accuracy, completeness, or reliability of any health information provided through the App.

4. User Accounts and Data

4.1 No Account Required

The App does not require you to create an account. Your data is stored locally on your device.

4.2 Your Responsibilities

You are responsible for:

  • The accuracy of the information you provide (supplement names, health goals, etc.).
  • Maintaining the security of your device.
  • Backing up your device if you wish to preserve your App data.
  • Any content you submit through the AI chat or contact form.

4.3 Data Loss

Since all data is stored locally on your device, we are not responsible for data loss resulting from:

  • Uninstalling the App
  • Device damage, loss, or theft
  • Operating system updates or resets
  • Any other circumstances beyond our control

5. Subscriptions and Payments

5.1 Subscription Plans

Volera may offer premium features through subscription plans. Subscription details, pricing, and features are presented within the App at the time of purchase.

5.2 Billing

  • All subscription purchases are processed through Apple's App Store.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • You agree to pay all fees and applicable taxes incurred through your subscription.

5.3 Auto-Renewal

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription rate.
  • You can manage and cancel your subscription through your Apple ID account settings.

5.4 Free Trials

  • If offered, free trial periods automatically convert to paid subscriptions unless canceled before the trial period ends.
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.5 Refunds

All refund requests must be directed to Apple, as payments are processed through the App Store. We do not process refunds directly. Visit https://support.apple.com/en-us/HT204084 for Apple's refund process.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Attempt to interfere with, compromise, or disrupt the App or its underlying infrastructure.
  • Use the App to transmit any harmful, offensive, or objectionable content through the AI chat feature.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use automated means (bots, scrapers, etc.) to access or interact with the App.
  • Circumvent, disable, or otherwise interfere with any security or access control features of the App.
  • Use the AI chat feature to generate content that is illegal, harmful, abusive, harassing, defamatory, or otherwise objectionable.
  • Attempt to extract, scrape, or harvest the AI model's training data or system prompts.

7. Intellectual Property

7.1 Our Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, animations, and design) are owned by Volera and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

7.3 User Content

By submitting content through the App (such as chat messages or contact form submissions), you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store that content solely for the purpose of providing and improving the App's services.

8. Third-Party Services

The App integrates with third-party services including:

  • OpenAI: For AI-powered wellness advisor functionality
  • Apple HealthKit: For health data integration (with your permission)
  • Superwall: For subscription management

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from use of the App will be accurate or reliable.
  • The quality of any information or content obtained through the App will meet your expectations.
  • Any errors in the App will be corrected.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOLERA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, data, use, goodwill, or other intangible losses.
  • Any damages resulting from your access to, use of, or inability to use the App.
  • Any damages resulting from any content obtained from the App, including health-related information or AI advisor responses.
  • Any damages resulting from unauthorized access to or alteration of your data.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Volera and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Any content you submit through the App.

12. Termination

12.1 By You

You may terminate your use of the App at any time by uninstalling it from your device. Active subscriptions must be canceled separately through your Apple ID account settings.

12.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including but not limited to a breach of these Terms.

12.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All locally stored data will be deleted upon uninstallation.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the App and updating the "Last Updated" date.

Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy and End User License Agreement, constitute the entire agreement between you and Volera regarding the use of the App and supersede all prior agreements and understandings.
